On the surface, Miranda seems simple. Miranda is, however, one of the most complex and litigated areas of the law. Recognizing when to read Miranda, and what constitutes a valid waiver is often complex and may turn on a single word or phrase. Determining if an individual is in custody or being interrogated can be a challenge to both officers and the courts.
